Surf Amigos Privacy Policy

Surf Amigos, operated by Eastbay Property Group Pty Ltd (ABN 23 648 271 630) (“we,” “our,” or “us”) is committed to protecting your privacy. This Privacy Policy explains how we collect, use, store, and share your information when you use our mobile application, website, and related services (collectively, the “Services”). Our practices comply with the General Data Protection Regulation (GDPR), Australian Privacy Principles (APPs), and relevant United States privacy regulations including state-level privacy laws such as the California Consumer Privacy Act (CCPA).

1. Information We Collect

We collect the following types of data:

  • Personal Information: Name, email address, date of birth, gender, profile photos, and other profile information you provide.
  • Account Credentials: Username, password, and login details.
  • Location Data: Approximate or precise location to help match users.
  • Usage Data: Interactions with the app, device type, IP address, app settings.
  • Payment Information: Information related to purchases, subscriptions, and transaction status for premium features processed by the applicable platform provider. We do not store payment details or billing addresses.
  • Communications: Messages exchanged with other users or with us.

2. How We Use Your Data

We process your personal data for the following purposes:

  • To create and manage your Surf Amigos account.
  • To provide matching services and personalized features.
  • To process payments for premium services.
  • To monitor, prevent, and detect fraud or illegal activity.
  • To improve app functionality and user experience.
  • To send important updates, support messages, and marketing communications (where consented).

We process your data under legal bases such as consent, contract performance,  legitimate interests, or compliance with legal obligations.

3. Sharing Your Information

We may share information:

  • With service providers ( hosting, analytics, payment processing ).
  • With advertising partners (Meta and TikTok) to measure how our ads perform. See section 10.
  • With legal authorities when required by law.
  • In connection with business transfers(e.g., merger or acquisition).
  • With other users (only limited profile information you choose to make public).

We may provide links to third-party weather, surf, tide, and sea-condition services. If you choose to access these services, limited location-related information (such as latitude and longitude included in the request) may be shared to display relevant local conditions.

These third-party services operate independently and have their own privacy policies. We do not control or take responsibility for their data practices.

We do not share your account profile information with these providers for advertising or marketing purposes.

4. Data Retention

We retain your data as long as necessary for your use of the Services or as required by law. You may request account deletion at any time, and your data will be removed within a reasonable period, except where retention is legally required.

5. Your Privacy Rights

Under GDPR (EU/EEA Users)

You have the right to:

  • Access and receive a copy of your data.
  • Request rectification, erasure, or restriction of processing.
  • Withdraw consent at any time.
  • Data portability.
  • Object to processing based on legitimate interests or marketing.

Under Australian Privacy Principles

You have the right to:

  • Access and correct your personal information.
  • Complain about breaches of privacy law to the Office of the Australian Information Commissioner (OAIC).

6. International Data Transfers

We may store and process your data in countries outside your jurisdiction. We use safeguards such as Standard Contractual Clauses (SCCs) for cross-border data transfers.

7. Account Deletion

You have the right to request deletion of your account and associated personal data at any time.

  • You can delete your account directly within the app: Profile → Settings → Account → Delete Account
  • If you are unable to access your account, you may request deletion by contacting us at: support@surfamigos.app
  • Requests must be sent from your registered email address and include your name for verification purposes.

What we delete When your account is deleted, we permanently delete your account login, profile (name, age, photos, bio, surf details and preferences), your quiver, sessions you created and your session memberships, invitations, community posts, marketplace listings, notifications, and your subscription record with our payments provider.

What we keep, and for how long

  • Messages you sent in chats remain visible to the other people in those conversations, with your name removed. (or: are deleted, if the backend is changed to do that)
  • Safety and moderation records, such as reports made by or about your account, are kept for [90 days] to protect our community, then deleted.
  • A record that your account was deleted (name, email, date) is kept for [90 days] so we can handle follow-up requests, then deleted.
  • Partner referral records are kept without your personal details, for partner reporting.
  • Purchase records for in-app subscriptions are held by Apple and Google under their own policies. We can’t delete these.
  • We may keep information longer if the law requires it.

Processing time In-app deletion happens immediately. Email requests are completed within 7 working days.
We will process deletion requests within 7 working days, unless retention is required by law or for legitimate business purposes.

8. Security

We implement appropriate technical and organizational security measures, including encryption, secure servers, and access controls, to protect your data.

9. Children’s Privacy

Our Services are not intended for users under 18. We do not knowingly collect data from minors.

10. Cookies, Tracking & Advertising Measurement

We use cookies, device identifiers and similar technologies to operate the app, analyse usage and personalise your experience. You can manage cookies through your device or browser settings.

We also use tools from Meta (Facebook and Instagram) and TikTok to understand which of our ads lead people to download and sign up for Surf Amigos. When you install or open the app, these tools may receive limited information such as your device’s advertising identifier, device type, operating system, IP address and app events like installs and registrations. We use this only to measure and improve our advertising. We don’t share your profile details, photos, messages or precise location with Meta or TikTok.

On iPhone, we only use your advertising identifier if you allow tracking when asked. You can change this at any time in Settings → Privacy & Security → Tracking. On Android, you can reset or delete your advertising ID in your device settings under Google → Ads (or Privacy → Ads).

11. Changes to This Policy

We may update this Privacy Policy periodically. Material changes will be notified through the app or email.
