TERMS AND CONDITIONS (TERMS OF SERVICE)

Welcome to Surf Amigos (“the App”), a platform designed to connect individuals interested in surfing and surfing-related activities. These
Terms and Conditions (“Terms”) govern your access to and use of the App and its services.

By creating an account or using the App, you agree to be bound by these Terms.

1. ELIGIBILITY

You must be at least 18 years old to use the App. By using the App, you confirm that:

  • You are legally capable of entering into a binding agreement
  • You will comply with all applicable laws and regulations

2. PURPOSE OF THE APP

The App is a social connection platform intended to help users meet others interested in surfing. The App does not:

  • Guarantee matches or successful connections
  • Verify the identity, skill level, or intentions of users
  • Provide professional, safety, or surfing instruction

3. USER CONDUCT

We enforce a zero-tolerance policy toward objectionable content, including but not limited to harassment, abuse, hate speech, sexually explicit material, violence, and illegal activities.

You agree to use the App respectfully and responsibly. You must not:

  • Harass, abuse, threaten, or harm other users
  • Share false, misleading, or deceptive information
  • Use the App for non-surfing-related purposes (e.g., commercial solicitation, escorting, or unrelated dating)
  • Engage in discriminatory, hateful, or offensive behaviour
  • Post or transmit inappropriate, explicit, or illegal content
  • Impersonate another person or misrepresent your identity

We reserve the right to suspend or terminate accounts that violate these rules.

4. SAFETY AND PERSONAL RESPONSIBILITY

Surfing and meeting others involve inherent risks. By using the App, you acknowledge and agree that:

  • You are solely responsible for your interactions with other users
  • You should exercise caution and good judgment when meeting others in person
  • You assume all risks associated with surfing, ocean conditions, travel, and in-person meetings
  • The App does not conduct background checks or guarantee user safety

You agree to take appropriate precautions, including:

  • Meeting in public places initially
  • Informing someone you trust about your plans
  • Assessing surf conditions and your own skill level

5. USER CONTENT

You are responsible for any content you upload, including profiles, photos, and messages. By submitting content, you grant Surf Amigos a
worldwide, non-exclusive, royalty-free license to use, display, and distribute your content within the App.

You must ensure your content:

  • Is accurate and not misleading
  • Does not infringe on third-party rights
  • Complies with applicable laws

6. ACCOUNT SECURITY

You are responsible for maintaining the confidentiality of your login credentials. You agree to:

  • Notify us immediately of any unauthorized use
  • Take reasonable steps to secure your account

7. LOCATION SERVICES

The App may use location data to facilitate matching. By using the App, you consent to the collection and use of your location data in
accordance with our Privacy Policy.

8. TERMINATION

We may suspend or terminate your account at our discretion if you:

  • Violate these Terms
  • Engage in harmful or inappropriate behaviour
  • Misuse the App

You may terminate your account at any time.

9. DISCLAIMERS

The App is provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, including:

  • Fitness for a particular purpose
  • Availability, reliability, or accuracy of the service
  • Safety or conduct of users

We do not guarantee uninterrupted or error-free operation.

10. LIMITATION OF LIABILITY

To the maximum extent permitted by law, [App Name] shall not be liable for:

  • Any indirect, incidental, or consequential damages
  • Personal injury, property damage, or losses arising from user interactions or
    surfing activities
  • Any actions or conduct of other users

11. USER SAFETY, REPORTING, AND ENFORCEMENT

Surf Amigos maintains a strict zero-tolerance policy for objectionable content and abusive behavior.

Surf Amigos uses manual moderation processes to review reported user-generated content and ensure compliance with these Terms.

Users can report content or block other users directly within the App. When a user is reported or blocked:

  • The reported user is immediately removed from the reporting user’s view
  • The report is submitted to our moderation team for review
  • The reported user may be restricted from certain features during review

We commit to reviewing all reports within 24 hours.

If a violation is confirmed, we will:

  • Remove the offending content
  • Suspend or permanently terminate the responsible user’s account

Blocked users cannot interact with or view the blocking user’s content.

Repeated or severe violations result in permanent removal from the platform.

These measures are in place to ensure a safe, respectful, and trustworthy community.

12. CHANGES TO TERMS

We may update these Terms from time to time. Continued use of the App after changes constitutes acceptance of the updated Terms.

13. GOVERNING LAW

These Terms are governed by the laws of Victoria, Australia, without regard to conflict of law principles.

15. COMMUNITY GUIDELINES (SUMMARY)

By using the App, you agree to:

  • Be respectful and honest
  • Use the App only for genuine surfing connections
  • Prioritize safety—yours and others’
  • Respect local surf etiquette and environmental conditions

16. Child Safety Standards & CSAE Policy

Surf Amigos has a zero-tolerance policy regarding the safety of children. To ensure a safe environment for our surfing community, we adhere to the following standards:

  • Explicit Prohibition of CSAE: We strictly prohibit any content, behavior, or imagery related to Child Sexual Abuse and Exploitation (CSAE).
  • Zero Tolerance for CSAM: Any Child Sexual Abuse Material (CSAM) identified on our platform will be removed immediately. Accounts responsible for such content will be permanently banned.
  • Reporting to Authorities: In compliance with global regulations and Google Play policies, we will report any instances of CSAM or child exploitation to the National Center for Missing & Exploited Children (NCMEC) and other relevant law enforcement agencies.
  • In-App Reporting Mechanism: Even though Surf Amigos is intended for users aged 18+, we provide an in-app reporting mechanism. Users can report any suspicious activity, chat, or content by using the “Report” button located on user profiles and within the chat interface.
  • Compliance with Laws: We comply with all applicable child safety laws and regulations, including the California Consumer Privacy Act (CCPA) and the Children’s Online Privacy Protection Act (COPPA), where applicable.
  • Child Safety Point of Contact: If you have any concerns or need to report a violation of these standards, please contact our dedicated Child Safety Point of Contact at support@surfamigos.app.

 

Failure to follow these guidelines may result in account suspension or removal.

By using the App, you acknowledge that you have read, understood, and agree to these Terms and Conditions.
